The Kuwaiti newspaper Al-Qabas stated that the Ministry of Social Affairs and Labor in Kuwait has defined new work controls for owners of small and medium enterprises in accordance with Resolution No. 9 of 2016, which allows entrepreneurs to be registered for employment according to the following conditions:
1- The owner of the project, the general manager of the project, the managing director, or the chairman of its board of directors, is a Kuwaiti national.
2 – The age should not exceed 45 years, and the committee may exempt from this condition.
3 – Not to be retired or a student.
4 – To obtain a license to practice the activity.
5 – The employer must be registered in Chapter Five of the General Organization for Social Insurance, provided that he provide the competent labor administration on an annual basis with a statement stating his continued registration.
6 – The ownership percentage of the company manager should not be less than 15% for new files, and in the event of amending the articles of incorporation that would modify the percentage of ownership, the SME management must be notified of this amendment.
7 – The capital of the foreign partner, if any, should not exceed 20%.
8 – Signing the declaration prepared by the General Authority of the General Forces for Business Owners, provided that the employer undertakes to attend to sign before the employee in charge in the administration in the event of opening the file, and that he is authorized to sign.
9 – To be provided to the competent department every 6 months, indicating the continuity of the rental relationship to the project headquarters.
10 – The Director General of the Public Authority for Manpower issues a decision regarding the controls and conditions for obtaining a clearance certificate regarding each of the facility manager and all partners and authorized to sign, before they are registered with the competent department.
